From South Africa to Gaza to British Columbia and Alberta:

Crime Wave Directed at the Elimination of Indigenous people

Many aspects of the world we are inheriting from our ancestors and are passing along to posterity go back to the trajectory of colonial history initiated in 1492 with Christopher Columbus’s initial trans-Atlantic voyage. The seizure by European powers of imperial control in the Americas initiated a process that continues to divide humanity. On one side of the divide are those on the delivering end of a colonizing process that never really ended. On the imploding side of colonization’s expansionary frontier are the Indigenous peoples. They are on the receiving end of an ongoing saga of dispossession, disempowerment and marginalization.

Proof of the continuing nature of this oppressive process is all too evident in the statistics of suicide, domestic violence, incarceration, unemployment, poverty, addictions and the like. These stats continue to demonstrate, unfortunately, that Canada is not a country of decency and equity where human rights are respected and protected from wholesale violation. Those referred to in Canada’s highest constitutional law as the “Aboriginal peoples of Canada,” as “Indians, Inuit and Metis,” are overwhelmingly overrepresented on the negative side of virtually every major index of morbidity, illness, and socioeconomic status.

The Aboriginal peoples of Canada are suffering because of a centuries-old crime wave directed in their direction. Often these crimes are sanctioned or actually committed by governments andScreen Shot 2014-08-30 at 4.53.17 PMpolice forces in Canada, in its ten provinces and in its three federal territories. The predatoryincursionscurrently suffered by the First Nations are epitomized by the 1,500 or so missing, murdered and traded Aboriginal women and girls that Canada’s racist criminal justice system cannot account for.

There is a growing swell of political pressure developing in Canada calling for a federal investigation into the phenomenon of missing, murdered and traded Aboriginal women and girls. This groundswell now extends even to many of Canada’s provincial premiers. Those who introduced the call for an investigation are closely connected to Idle No More, a very important movement whose most erudite activists have been doggedly exposing the links connecting the repression of Indigenous peoples in Canada and Palestine/Israel. This comparison is epitomized by the anti-Aboriginal policies of Stephen Harper, Canada’s neocon Prime Minister who has outdone even US politicians in displaying utter subservience to the anti-Palestinian dictates of Benjamin Netanyahu and his Likudnik obsessions.

A First Nations protest At Queen’s Park in Ontario (Credit: Rainforest Action Network/cc/flickr)In a landmark ruling on Thursday with potential implications for the planned Northern Gateway pipeline, Canada’s Supreme Court unanimously granted an aboriginal land title to the Tsilhqot’in First Nation, giving them claim to more than 1,700 square kilometers in British Columbia.

“British Columbia breached its duty to consult owed to the Tsilhqot’in through its land use planning and forestry authorizations,” the 81-page decision (pdf) states.

“I didn’t think it would be so definitive,” said Grand Chief Stewart Phillip, president of the Union of B.C. Indian Chiefs. “I was actually prepared for something much less.”

The decision rejected the narrow view of what qualified for protection under aboriginal rights from a 2012 ruling by the B.C. Court of Appeal. While the lower court had said aboriginal groups must be able to prove intensive historical use of a specific site, Thursday’s decision accepts a broader set of criteria particularly important for the Tsilhqot’in, a historically “semi-nomadic” people. Indigenous groups must now prove a looser definition of occupation, continuity of habitation on the land, and exclusivity in an area in order to be granted a title.

“It only took 150 years, but we look forward to a much brighter future,” said Chief Phillip. “This without question will establish a solid platform for genuine reconciliation to take place in British Columbia.”

The ruling will potentially apply to any lands in the country that were never ceded to the crown, including lands which the Northern Gateway pipeline is slated to run through, and many others that have been the sites of development and resource extraction.

“They are the rightful stewards of their lands, and should be the ones to decide if and how they are developed,” said Maude Barlow, National Chairperson of the Council of Canadians,which intervened in the case in support of the Tsilhqot’in, in a statement released by the group. She stated her optimism that the decision is a sign “that there is no blank cheque for the Northern Gateway project.”

While the Tsilhqot’in are overjoyed with the ruling, there may be some unforeseen negative aspects to it that will still allow for corporate exploitation of aboriginal lands. As the Toronto Starreports:

… [T]he ruling will also be welcomed by industry and governments because the high court says provincial and federal governments may regulate economic activity like forestry on title lands. Lawmakers can do so either by consulting and getting consent of the aboriginal group, or by establishing a pressing and substantial public purpose and ensuring the regulated activity fulfils the Crown’s “fiduciary” duty to act in good faith for the benefit of aboriginal peoples.

From Solidarity Spring To Sovereignty Summer: An International Callout To All Indigenous Peoples, Supporters, Allies Of Idle No More & Defenders Of The Land

Over the past few months, Idle No More has ignited a spiritual fire in the hearts of Indigenous and non-Indigenous Peoples to come together to address issues related to: Honoring Treaties and Indigenous Sovereignty, Human Rights, Deepening Democracy reflecting a meaningful Nation to Nation relationship, and increasing Environmental Protections and protecting Mother Earth.

In March, Idle No More joined forces with Defenders of the Land to launch a Declaration that calls on all People to participate in a campaign that was called Solidarity Spring and Sovereignty Summer.

Idle No More and Defenders of the Land are now transitioning into Sovereignty Summer and people are calling for increased and escalated activities. The actions aim to bring attention to the Harper government agenda that undermines the rights of Indigenous Peoples, Canadian citizens, and the ongoing policies disrupting Indigenous peoples lives such as land claims, third party management, and no free and prior consent to development on Indigenous lands. We are in a critical time where lives, lands, waters and Creation are at-risk and they must be protected.

The Harper government is moving quickly to pass the suite of legislation (C-45, C-428, S-2, S-6, S-8, S-212, C-27, and the First Nation Education Act) that undermines the treaties, our nation-to-nation relationship and Indigenous sovereignty, which is the last stand to protect our lands. Idle No More calls on non-Indigenous people to join Indigenous communities in coordinated non-violent direct actions in the summer. Alternatives will only come to life if we escalate our actions, taking bold non-violent direct action that challenges the illegitimate power of corporations who dictate government policy.

People have been inspired to engage in creative activities of reclaiming, resurgence and resistance in exercising their Nationhood in ways they see appropriate for them. There has been a historic Turtle Lodge Treaty signing ceremony on Indigenous education, nations have reclaimed sacred spaces and peoples continue to protect their lands from invasion. There is a spiritual energy stirring and a large awakening is on the horizon as we transition to Sovereignty Summer. The spirit in which Idle No More began was through the resurgence of Indigenous laws and it is only appropriate for the resurgence of our spiritual and ceremonial practices which are the foundation of our Nations to guide us into this transitioning period. The time for Unity and Solidarity is NOW, our future generations are depending on us and asking us to come together to think about what we will leave for them.

~ A CALLOUT TO ALL INDIGENOUS PEOPLES, SUPPORTERS AND ALLIES OF IDLE NO MORE ~

Leading into Sovereignty Summer, Idle No More calls on all people to join in a grassroots gathering for a Public Awareness Campaign in all Cities, Towns, Indigenous Communities and Villages across Canada and Internationally.

WHEN:
An on-going gathering and occupation, starting on Saturday, May 25, 2013 at 5:00pm and continuing once a week, at the same time and at the same place as people/ groups see appropriate for them. As we move closer to summer, Nations/peoples/ groups may want to increase the frequency of their gatherings to each day of the week on a consistent basis.

WHERE:
People can determine for themselves the appropriate location that has significance to them. For those in urban Centres this could be: prominent Government Buildings (Federal or Provincial) in Canada and at Canadian Embassies around the World. For those in their communities, this could be sacred sites, places of cultural importance and locations that are significant to people.

WHY:
To bring awareness to the public at large of the mission of the Idle No More Movement. To honor, fulfill and solidify Unity and Solidarity with all who support Idle No More in your community, city, town or village. This is not a onetime event but an ONGOING CAMPAIGN leading into Sovereignty Summer.

HOW:
Gather, Occupy, Rally and bring your songs, dancing, drums, signs, banner, flags and get to know and network with those who share your passion for the mission of the Idle No More Movement. Those events that wish to end with a March are encouraged to do so if your numbers permit.

Last night we gave a keynote about the Achuar/Talisman campaign to a packed house as part of Public Interest Alberta’s advocacy conference Fighting for our Future: People Power vs Corporate Control. The evening featured a special multimedia message from Achuar leader Peas Peas Auyi, who called up from the Amazon to be sure we recorded and delivered his words of gratitude to allies in Canada:

Prime Minister Stephen Harper has passed legislation to let China’s China National Offshore Oil Corporation buy to Nexen. This takeover deal among other things puts three to six billion barrels of tar sands oil in CNOOC’s hands, would create devastating global climate effects if CNOOC exploits Nexen’s reserves to their fullest extent.

Canada has also legally exited the Kyoto Protocol just today, as well as already removed the protection of over 2 million lakes and rivers – allowing tar sands development anywhere.

And the Foreign Investment Promotion and Protection Agreement (FIPA) international treaty passed and can come into effect at any given moment without notice. CNOOC will be able to sue Canadian governments in tribunals if our governments do anything to counter its growing interests, including common sense environmental protections and job creation efforts. Keep in mind that more than 130 First Nations have signed the Save The Fraser Declaration banning Enbridge Pipeline in their territories.

And the most damaging piece of legislation is the omnibus Bill C-45, the Federal Government vacates jurisdiction over waters, parks, fisheries, etc – and no longer has the responsibility and duty to consult First Nations concerning land development as legally required in our Treaties. It also gives power to decide fate of individual First Nations – even in Treaty Territory.

These new bills (there are several more to come) legally strip us of our legally binding treaty rights, which the Canadian government has no legal jurisdiction to alter or change. Bill C-45 is an unconstitutional bill which illegally alters long standing treaties between our two sovereign nations, effectively ending them along with our sovereign nation status. Not only does this drastically affect First Nation’s people, it also directly affects all North Americans and future generations – causing irreparable damage to the environment and its inhabitants.

The Idle No More movement which protests these undemocratic changes has spread via social media, and has garnered around 80% sheer hatred toward us for ‘complaining about treaties and free money’ when we should be ‘working and paying taxes like everyone else’.

Even though we’ve tried to reason with some of these individuals by explaining the above information to them, most don’t change their views out of spite. So alerting the Canadian public to hopefully garner support to sway the bill is out of the question for us.

Bill C-45 receives Royal Assent on Monday, which could signal the last time I can email you anything regarding this (as it can be construed as illegal under the new FIPA treaty which can go in effect at any moment without notice, and my band could be sued and be forced to pay crippling fees for months).

I and my sovereign Nation are urgently asking for your help. We need your help to alert and inform the international community and bring in sanctions against the Harper government for these numerous illegal and unconstitutional attacks on our environment and sovereign nation… it’s our only hope to protect this great land and future generations.

Native Rights Emergency in Canada RIGHT NOW- Bill C-428 (Please Share widely!)

I just received the text below in an email from my friend Harrison Friesen, who is a Native activist in Canada. I am going to do some research on C-428 and post articles as soon as I can. WordPress seems to hate my computer as it refuses to load 90% of the time so it may take me a bit to get things posted. Please feel free to share this, I think we are going to need some help and solidarity from people all over, both in Canada and other countries.
It appears to me that the cabal in their cornered rat phase are simply stepping up and making more obvious and severe all the horrid things they already do-so doing their utmost to disenfranchise and harm Native peoples is no surprise. It can’t be allowed to go forward tho-so please do whatever you can by sharing info, emailing leaders, protesting, praying etc and I will post more info as soon as I am able.

If this bill C-428 passes the XL pipeline and the Enbridge pipeline will go through without hesitation and so will Bill C 45.
They will destroy the lands and poison the waters that belong to our children and our grandchildren..Under Bill C-428 without our treaties we can no longer fight as a first nation. We will become municipalities and will no longer have our reserves.. Those reserves that are not ready for self governence today will be most effected..
